1. Scope and Contractual Partner

These General Terms and Conditions (T&Cs) apply to all orders placed via the online shop of JAKA Family Collective.

A consumer within the meaning of these T&Cs is any natural person who enters into a legal transaction for purposes that predominantly can neither be attributed to their commercial nor their self-employed professional activity.

2. Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) By clicking the button that completes the ordering process ("Buy now"), you submit a binding offer to conclude a purchase agreement.

(3) The contract is concluded:

* For payment in advance / invoice: As soon as we accept your order by sending an order confirmation via e-mail or by dispatching the goods.

* For real-time payment methods (e.g. PayPal, TWINT, credit card, Sofort / instant bank transfer): Immediately at the time the payment transaction is successfully triggered by you, provided you were previously informed of all essential contract details.

After placing your order, you will immediately receive an e-mail confirming the receipt of your order. This confirmation does not yet constitute acceptance of your offer.

3. Prices and Payment Terms

(1) All prices stated in the online shop are final prices and include statutory Value Added Tax (VAT) (where applicable).

(2) Since deliveries to Switzerland or Liechtenstein are dispatched from Switzerland, no import duties apply to the customer.

(3) Any shipping costs will be indicated separately during the ordering process. The shipping costs are already displayed on the product page and separately shown in the shopping cart prior to completing the order. Unless stated otherwise, all prices are final prices (incl. statutory VAT).

Free Shipping: For orders in CHF (delivery to CH/FL), we offer free shipping on orders of 50.00 CHF or more.

(4) We offer the following payment methods: Payment in advance, TWINT, PayPal, credit card, Sofort / instant bank transfer. Additional fees may apply for certain payment methods, which will be clearly indicated during the ordering process.

4. Delivery and Retention of Title

(1) We deliver to Switzerland and Liechtenstein. Delivery times are specified on the respective product page.

(2) The goods remain our property until full payment has been received.

5. Right of Withdrawal and Returns

(1) For consumers habitually resident in the EEA (Liechtenstein), a statutory 14-day right of withdrawal applies. Details can be found in our separate Cancellation Policy, which is made available to you before the conclusion of the contract and can be accessed at any time here.

(2) For consumers residing and having their delivery address in Switzerland, we voluntarily grant a contractual right of return under the same conditions and timeframes as the statutory EU right of withdrawal. The process and deadlines are entirely governed by our central Cancellation Policy.

(3) The right of withdrawal does not apply to contracts for the supply of goods made to customer specifications or clearly personalized, nor for sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery.

6. Special Product Information (Amber Necklaces & Accessories)

(1) Certain products in our range (in particular amber necklaces) are natural products and contain small parts that can be swallowed. If handled improperly, they pose a risk of strangulation and choking for babies and young children.

(2) The customer undertakes to strictly observe the safety and warning instructions accompanying the products. In particular, amber necklaces must only be worn under the direct supervision of an adult and never while the child is sleeping. The customer shall be fully liable for any damage resulting from non-compliance with the safety and warning instructions, to the extent permitted by law.

7. Warranty and Liability

(1) Statutory warranty rights under Swiss law apply.

(2) We are liable without limitation for damages resulting from injury to life, body, or health, as well as in cases of intent and gross negligence.

(3) In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract. Liability for damage caused by improper use of the goods (in particular non-compliance with safety and warning instructions for baby accessories) is excluded to the extent permitted by law. The customer shall be fully liable for any damage resulting from non-compliance with safety and warning instructions, to the extent permitted by law.

8. Applicable Law and Jurisdiction

(1) For contracts with customers habitually resident in Switzerland or Liechtenstein, Swiss law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG), insofar as this does not deprive the customer of the protection afforded to them by mandatory provisions of the law of their state of residence.  

(2) For consumers habitually resident in the EU or Liechtenstein, mandatory consumer protection regulations of the state of residence remain unaffected (Art. 6 Rome I Regulation).

(3) To the extent permitted by law, the place of jurisdiction shall be the registered office of JAKA Family Collective KlG in Ibach. For consumers, the statutory jurisdictional rules of their place of residence apply.
